The Cybercrime Prevention Act (RA 10175) went into effect today, and you need to protect yourself from penalties such as imprisonment (1 month and 1 day to 6 months) or fines (P50,000 to P250,000), or both.
Ano po ang makikita natin sa Section 4 ng RA 10175:
(3) Unsolicited Commercial Communications. — The transmission of commercial electronic communication with the use of computer system which seek to advertise, sell, or offer for sale products and services are prohibited UNLESS
(i) There is prior affirmative consent from the recipient; or
(ii) The primary intent of the communication is for service and/or administrative announcements from the sender to its existing users, subscribers or customers; or
(iii) The following conditions are present:
(aa) The commercial electronic communication contains a simple, valid, and reliable way for the recipient to reject. receipt of further commercial electronic messages (opt-out) from the same source;
(bb) The commercial electronic communication does not purposely disguise the source of the electronic message; and
(cc) The commercial electronic communication does not purposely include misleading information in any part of the message in order to induce the recipients to read the message.
Prior Affirmative Consent - May prueba po ba kayo na binigyan kayo ng pahintulot na i-photo-tag mo ang isang tao, kahit hindi siya nakikita sa "photo" mo (na sa totoo lang ay isang commercial advertisement)?
Primary intent of the communication is for service and/or administrative announcements - Kapag nag-photo-tag po kayo ng tao sa FB, at ang photo ay commercial advertisement (mga income claims, mga photo ng cheke ng high earnings, mga hikayat na sumali sa business oppportunity), hindi po yan "administrative announcement" lamang.

The commercial electronic communication does not purposely include misleading information in any part of the message in order to induce the recipients to read the message. - Kapag tiningnan po ng isang tao ang photo/advertisement kasi akala niya nung ti-nag siya na kasama siya sa picture...
...tapos yun pala wala naman siya sa picture, kundi advertisement lang pala...
...ang tawag po diyan: misleading.
Kapag ganun ang sitwasyon, SPAM po ang tawag diyan sa random photo-tagging na 'yan.
Sino ang maghahabla sa mga photo-tag spammers sa Facebook?
Mukha nga po na hindi praktikal. Maraming EFFORT para lang po magreklamo, maghanap ng abogado, at mag-file ng kaso ang mga complainant laban sa random photo-tagging.
